NSW: Carr believes appeal can overturn Presland payout=2

Mr Carr said a person who has committed a criminal act was now prevented from seekingdamages under changes to public liability laws passed last year.

"This action commenced before the new laws came into force," he said.

But Mr Carr defended the division of power between the judiciary and government.

"That is part of our freedom, frankly.

"If anyone saw me trying to usurp all the powers that reside with the judiciary there'dbe uproar," he said.

"You don't throw the baby out with the bathwater: you live with the constraints ofan independent judiciary.

"We grumble about it, we criticise them and we amend the laws as appropriate, but you'vereally got to live with the fact that from time to time court decisions anger you anddisappoint you."
